17.09.2019 года вступило в законную силу решение тимирязевского районного суда города москвы по гражданскому делу по иску о признании завещания недействительным (информация по делу 02-0056/19), в котором я принимала участие в качестве представителя на стороне истца. Суд удовлетворил требования моего доверителя и истца по делу, признал завещание, составленное на имя ответчика, недействительным.

Обстоятельства наследственного спора о признания завещания недействительным.

В июле 2017 года умер наследодатель. После смерти наследодателя открылось наследство, состоящее из 2-х комнатной квартиры. Наследником по завещанию к имуществу наследодателя являлся её родной брат (далее – истец). Завещание на истца было составлено в 2000 году и удостоверено нотариусом города москвы. Обратившись к нотариусу с заявлением о принятии наследства, истцу стало известно о том, что в наследственном деле имеется новое завещание наследодателя, составленное в 2013 году по которому все принадлежащее на день смерти наследодателя имущество было завещано сестре наследодателя (далее – ответчик).

Однако, по мнению истца, наследодатель в результате перенесенного в 2013 году инфаркта головного мозга, страдала психическим расстройством личности в связи с сосудистым заболеванием. У нее имелись явно выраженные интеллектуальные и эмоциональные нарушения, что не могло не отразиться на восприятии происходящих событий и всех юридических последствий заключаемой сделки. Указанные выше обстоятельства явились поводом для обращения в суд с иском о признании завещания недействительным.

Назначение посмертной судебно-психиатрической экспертизы.

Определением тимирязевского районного суда г. Москвы по делу была назначена посмертная судебно-психиатрическая экспертиза с целью установления психического состояния наследодателя на момент составления завещания, где на разрешение экспертов были поставлены вопросы:

• Страдала ли наследодатель какими-либо заболеваниями, препятствующими ей понимать значение своих действий и руководить ими в момент составления завещания?


• Могла ли наследодатель отдавать отчет своим действиям и руководить ими в момент составления завещания?

Результаты судебно-психиатрической экспертизы.

Согласно заключению судебно-психиатрической экспертизы наследодатель страдала психическим расстройством в форме органического расстройства личности в связи с сосудистым заболеванием, появлении на фоне длительно протекающей сосудистой патологии (ИБС, гипертоническая болезнь) признаков хронической ишемии головного мозга. Указанные психические расстройства способствовали нарушению целостного осмысления и оценки существа сделки, прогнозу её правовых последствий и лишали наследодателя способности понимать значение своих действий и руководить ими в юридически значимый период на момент составления завещания.

Юридически значимые обстоятельства в наследственном споре о признании завещания недействительным.

Юридически значимым обстоятельством по данному делу об оспаривании завещания являлось установление факта возможности наследодателя на момент составления оспариваемого завещания осознавать характер и последствия своих действий.

В экспертном заключении экспертами было отражено, что психические расстройства наследодателя способствовали нарушению целостного осмысления и оценки существа сделки. В выводах экспертов врачами-психиатрами был дан четкий и ясный ответ о том, что наследодатель по своему психическому состоянию не могла осознавать значение и характер своих действий и руководить ими в юридически значимый период.

Правовое обоснование исковых требований о признании завещания недействительным.

Завещание как односторонняя сделка является отражением воли наследодателя на распоряжение имуществом на случай смерти. С учетом правового содержания ст. 153 ГК РФ, а также общих условий действительности сделок, последние представляют собой осознанные, целенаправленные, волевые действия лиц, совершая которые, они ставят цель достижения определенных правовых последствий.

В силу п. 1 ст. 177 ГК РФ сделка, совершенная гражданином, хотя и дееспособным, но находившимся в момент ее совершения в таком состоянии, когда он не был способен понимать значение своих действий или руководить ими, может быть признана судом недействительной по иску этого гражданина либо иных лиц, чьи права или охраняемые законом интересы нарушены в результате ее совершения.

Отсутствие способности понимать значение своих действий или руководить ими влечет искаженное понимания лицом существа совершаемой сделки, ее правовых последствий или утрату способности руководить своими действиями в соответствии со сформировавшейся волей.

Суд удовлетворил исковые требования о разделе совместно нажитого имущества супругов, признав за каждым по ½ доли в праве на квартиру.

Очередное интересное гражданское дело по семейному спору о разделе имущества супругов достигло своего логического завершения. Исковые требования моего доверителя, по семейному спору о разделе приобретенной в браке квартиры, признании ½ доли в праве на квартиру удовлетворены в полном объеме, решение савеловского районного суда города москвы вступило в законную силу (информация по делу № 02-3180/2017).

Моя работа, как адвоката по семейным спорам выполнена в полном объеме.

Обстоятельства семейного спора о разделе совместно нажитого имущества супругов, спустя 20 лет после расторжения брака.

Ко мне обратился клиент, который расторг брак со своей супругой еще в 1997 года. В период брака в 1993 году, он и его супруга приобрели 2-х комнатную квартиру в ЖСК. Право собственности было оформлено на супругу, так как она являлась членом жилищного кооператива. После расторжения брака в 1997 году, бывшие супруги непродолжительное время продолжали проживать вместе в квартире. В 2000 году мой доверитель выехал из квартиры и уехал жить в ярославскую область. Однако связь с бывшей супругой продолжал поддерживать, периодически приезжая в квартиру, в которой сохранил регистрацию.

В 2017 году бывшая супруга моего доверителя решив, что все имущественные вопросы между ней и бывшим мужем давно решены и квартира принадлежит только ей, обратилась в савеловский районный суд с иском о признании бывшего супруга утратившим право пользования квартирой, снятии его с регистрационного учета, одновременно выставив квартиру на продажу. Савеловский районный суд в иске о признании утратившим право пользования квартирой бывшей супруге отказал. Именно на этой стадии ко мне и обратился клиент, интересы которого я взялась представлять в савеловском районном суде города москвы по иску о разделе совместно нажитого имущества.

Доказательства по семейному спору о разделе имущества и юридически значимые обстоятельства.

Справедливости ради, хочу сказать, что активное участие в судьбе моего доверителя принимали его старший сын и сноха, которая очень помогла мне в моей работе по сбору доказательств по делу. Учитывая, что иск о разделе имущества был нами подан спустя 20 лет после расторжения брака, конечно надо было собрать «железобетонную» доказательственную базу для подтверждения тех обстоятельств, которые послужили бы основанием для удовлетворения исковых требований. В ходе рассмотрения дела в суде были сделаны адвокатские запросы, ответы на которые приобщены к материалам дела, допрошены свидетели, заявлены ходатайства и пр..

Суд не применил срок исковой давности по спору о разделе имущества супругов.

Со стороны бывшей супруги, её адвокатом было заявлено ходатайство о применении срока исковой давности и отказе в удовлетворении исковых требований по этим основаниям. Это логично. Будь я на месте адвоката ответчика по такому спору, я бы заявила такое же ходатайство и постаралась бы убедить суд в том, что срок исковой давности пропущен. Однако я была на другой стороне. Поэтому, понимая всю опасность сложившейся ситуации, я направила все свои усилия и применила профессиональные навыки на то, чтобы убедить суд в том, что до 2017 года права моего доверителя нарушены не были, соответственно срок исковой давности пропущен быть не может, как не может быть отказа в удовлетворении исковых требований по этим основаниям.

Суд, выслушав мои доводы, доводы истца, ответчика, показания свидетелей, как с нашей стороны, так и со стороны наших оппонентов, вынес решение о разделе имущества супругов в равных долях. С учетом обстоятельств самого дела, в котором мне пришлось принять самое активное участие и стать невольным свидетелем личностных взаимоотношений, как между бывшими супругами, так и между родителями и детьми, данное решение суда, на мой взгляд, является не только законным и обоснованным решением по спору о разделе совместно нажитого имущества супругов, оно еще является справедливым и человечным.
